Florida Homicide Charges Under Chapter 782

Florida Statutes Chapter 782 governs homicide offenses and establishes several distinct categories of charge. The specific charge affects everything: the required proof, available defenses, and potential sentence.

First-Degree Murder
A capital felony under Florida Statute 782.04, covering premeditated killings and killings committed during the commission of certain serious felonies, known as the felony murder rule. Conviction can result in the death penalty or life in prison without parole.

Second-Degree Murder
Applies to acts imminently dangerous to another person and showing a depraved indifference to human life, without premeditation. This is a first-degree felony that can carry a life sentence.

Third-Degree Murder
Charged when a death occurs during the commission of a non-violent felony, without intent to kill. It is a second-degree felony with a maximum of 15 years in prison.

Manslaughter and Aggravated Manslaughter
Manslaughter under Florida Statute 782.07 covers unlawful killings that don’t meet the criteria for murder and is typically charged as a second-degree felony. When the victim is a child, elderly person, disabled adult, or first responder, the charge becomes aggravated manslaughter. This is a first-degree felony punishable by up to 30 years in prison.
