How Florida Law Defines Stalking

Under Florida Statute Section 784.048, the state must prove that a defendant willfully, maliciously, and repeatedly followed, harassed, or cyberstalked the alleged victim. Each of those words carries legal weight.

Harassment is defined as a course of conduct directed at a specific person that causes substantial emotional distress and serves no legitimate purpose. A course of conduct is a pattern of acts over a period of time, however short, showing a continuity of purpose. Constitutionally protected activity, such as organized protest, is explicitly excluded. Willfully means the conduct was knowing, intentional, and purposeful. Accidental or inadvertent contact doesn’t satisfy this element.

Stalking Charge Levels & Penalties in Florida

Florida law distinguishes misdemeanor stalking from aggravated stalking, and the difference in consequences is significant.

Basic stalking is a first-degree misdemeanor carrying up to one year in jail, a fine of up to $1,000, and possible probation. Aggravated stalking is a third-degree felony that can result in up to five years in prison. Several circumstances can elevate a charge to the felony level:

The defendant made a credible threat to the victim or to the victim’s family or close associates
The conduct occurred while the defendant was subject to an existing injunction for protection or no-contact order
The alleged victim was under the age of 16
The defendant had previously been sentenced for certain sex offenses and was under a court-imposed prohibition against contacting the same victim

Following a conviction, a sentencing court may also impose a no-contact order restricting communication with the victim for up to 10 years.

Cyberstalking Under Florida Statute Section 784.048

Cyberstalking is a recognized form of stalking under Florida law. It occurs when a person engages in a course of electronic communication directed at a specific individual that causes substantial emotional distress and serves no legitimate purpose. The statute also covers accessing or attempting to access the victim’s online accounts or internet-connected home electronic systems without permission.

A stalking charge can arise from cyberstalking even when there has been no physical or face-to-face contact between the accused and the alleged victim. Depending on whether a credible threat was made or other aggravating factors apply, cyberstalking may be charged as a first-degree misdemeanor or a third-degree felony.

Can I Be Charged With Stalking If the Other Person Never Told Me to Stop?

Florida law doesn’t require the alleged victim to have warned you to cease contact. The standard under Florida Statute Section 784.048 is whether the conduct was willful, malicious, and repeated and whether it caused the other person substantial emotional distress. The absence of an explicit warning doesn’t prevent charges from being filed.

What Happens If a Stalking Injunction Is Filed Against Me Alongside Criminal Charges?

A stalking injunction is a civil matter that proceeds on its own track, separate from any criminal case. Violating the injunction can itself result in new criminal charges, and its existence can complicate the criminal defense. A defense strategy may need to account for how the two proceedings interact, including what is said and filed on the civil side.

Does a Stalking Conviction in Florida Stay on My Record?
