Florida Money Laundering Laws & Felony Tiers

Florida Statute §896.101 defines money laundering around three criminal intentions: promoting unlawful activity, concealing the proceeds of criminal conduct, and structuring transactions to avoid state reporting requirements. Prosecutors don’t need to prove the defendant committed the underlying crime. They only need to show that the defendant conducted a financial transaction knowing the funds came from criminal activity.

Felony Classification by Transaction Value

Florida treats money laundering as a felony offense at every level. The classification depends on the total value of transactions conducted within a 12-month period. That lookback window matters because prosecutors can aggregate multiple smaller transactions to reach a higher felony tier.

The three classification levels under Florida law:

  • Exceeding $300 but less than $20,000: Third-degree felony, punishable by up to 5 years in prison.
  • $20,000 to less than $100,000: Second-degree felony, punishable by up to 15 years in prison.
  • $100,000 or more: First-degree felony, punishable by up to 30 years in prison.

Florida courts can also impose fines of up to twice the value of the laundered transactions on top of statutory maximums. In high-value cases, that financial exposure alone can be devastating.

When Federal Charges Apply

Federal prosecutors can step in when alleged transactions cross state lines, involve a federally insured financial institution, or affect interstate commerce. Federal charges typically arise under 18 U.S.C. §1956, which covers concealment, promotion, structuring, and tax evasion, and 18 U.S.C. §1957, which targets transactions over $10,000 derived from specified unlawful activity. Federal sentences follow mandatory guidelines and carry a minimum service requirement of 85% of the imposed sentence. In some cases, state and federal charges can proceed simultaneously for the same underlying conduct.
